Child gets 2.35 Million for Birth Injury
A 4-year-old Illinois boy has been awarded 2.35 Million dollars as compensation for permanent damage he sustained at birth. According to Attorney Joe Kolar, the child suffered severe nerve damage while at Vista Medical Center East in 2004.
A Lake County jury found that Dr. Pankaj D. Thaker was responsible for pulling too hard on the boy's head and neck when the boy's shoulder became stuck against the mother's pubic bone.
"The money is fine, but it is still not fair," said Silvia Cortez, the boy's mother. "The doctor made a mistake and should be punished for it."
The boy has undergone two shoulder surgeries at Children's Hospital of Wisconsin and several physical therapy sessions. He may also need surgery later this year.
