Specifically, at some point during the birthing process or in the womb, the child is deprived of oxygen. This results in a specific type of brain injury that causes cerebral palsy. Because it is an injury to the brain, it does not heal. This also means that it is not degenerative, though symptoms sometimes worsen as the child grows older. There are specific symptoms of this disorder that sometimes necessitate that the affected child has long-term care.

In some cases, parents may want to consider pursuing lawsuits for cerebral palsy if it was the result of negligence during the birthing process.

A cerebral palsy attorney will need to establish that the cerebral palsy in your infant was not the result of natural causes. This type of injury can occur to a child for many reasons, not just negligence during delivery. If the doctors or the institution that the infant was delivered at are to blame, you may be able to file a suit. Not every lawsuit is going to win. Part of the service an attorney provides is informing you whether or not there’s really a case to be made on your behalf. If not, you could lose money in legal fees if the attorney took it anyway. The way to get around this is called working on a contingency.

If your infant's cerebral palsy was not the result of negligence, an attorney working on contingency has no vested interest in taking it.
