The Financial Consequences of Cerebral Palsy
When you find out that your newborn has a baby injury, it’s unlikely that the financial implications of that injury will be the first things on your mind. It won’t be long, however, before you end up realizing that you may be facing particularly high medical expenses if your child comes down with specific types of medical conditions that result from baby brain damage. If your child is diagnosed with CP, consider the costs that you may be facing.
- Ongoing medical treatments
- Extra care for the child
- Hearing aids
- Wheelchairs and other mobility assistance devices
- Special education and tutors
These costs can be very high and, if the injury was due to medical negligence, you shouldn’t have to face them alone.
Filing a Lawsuit
One of your options in these cases is filing a lawsuit over the baby injuries. This can be almost as intimidating as dealing with the expenses themselves, but it may end up being something you can do without worrying about paying for the legal fees up front. This depends upon the attorney you work with and how they’re willing to take on your case. If you find an attorney that works on contingency, you’ll only have to pay legal fees if they win your case. If not, you pay nothing at all.
Assessing Your Case
It takes a qualified attorney to assess whether or not your case is worth pursuing. This means that you’ll have to meet with them beforehand to discuss whether or not your case is likely to win an award from a jury or a settlement from the provider that you’re suing.
This part of the process is called a consultation and it can also, under a contingency agreement, be taken on without having to pay for it up front. This allows you to at least meet with an attorney and see what they think. If they think that your case is good and want to pursue it, they may agree to take it on.
Don’t hesitate to explore this option. With a good attorney, you’ll have access to medical and legal expertise that makes it possible for you to find out whether or not there’s a case worth pursuing. Perhaps there is, perhaps there isn’t, but the only way to find out for sure is to speak with one of these legal professionals and to find out whether or not they feel that you have a chance in court.
