How Baby Brain Damage Occurs

Obviously, pregnancy is a very complex process and there are myriad different things that can go wrong during the course of it. In some cases, infants end up with brain damage, which can have devastating consequences.

In the Womb

This can happen for many different reasons and, unfortunately, there is oftentimes nothing that can be done to avoid this from happening. In many cases, the brain damage is not discovered until the child is actually born. With better medical technology being developed all the time however, there are an increasing amount of cases where brain damage can be averted in the womb.

Outside the Womb

Baby brain damage sometimes occurs after the child has been delivered, or during the delivery process. Again, some of these cases happen in ways that make it impossible for anyone to intervene in a way that would have a meaningful effect for the infant. The child may have complications during delivery that no amount of medical intervention could have remedied and, in these situations, there is little that can be done.

Medical Negligence

There are cases where a baby injury is directly attributable to medical negligence. In these cases, the doctors could have done something, or should not have done something that they did do, and that caused the injury. In these cases, the doctors may be liable for damages from a jury award or may have to settle with the child's parent, if the parent chooses to sue.

Suing for the Injuries

It's important to understand that children who are injured due to medical negligence are truly victims. The purpose of this law is to make sure that parents have a way to recover damages that can help pay for their expenses, which can be very high, that are direct results of the injury.

The first step in taking up one of these legal actions, obviously, is contacting a lawyer. The attorney may be willing to meet with you for free to determine whether or not you have a case. If they are, they can review the circumstances and see if they believe that there is cause to sue for medical negligence. If there is cause to sue, the jury will have to decide whether or not negligence really played a role in the child's injuries. In some cases, the awards for these actions are very high; enough to cover the medical costs incurred.
