Illinois Woman Files Lawsuit Against Hospital for Daughter's Cerebral Palsy
An Illinois woman has filed a lawsuit against Memorial Hospital, St. Louis University and one of their physicians. She claims that her daughter has cerebral palsy and other medical issues as a result of the doctor's negligence.Linda Overmeyer's daughter, Haley Overmeyer, was born January 9, 2005 at Memorial Hospital and was attended to by Dr. William Keenan, according to a complaint that was filed Dec. 31 in St. Clair County Circuit Court.
According to allegations, Keenan was negligent in his treatment of Haley Overmeyer by failing to properly resuscitate Haley, failing to appropriately and properly intubate her and failing to monitor her.
As a result of Keenan's alleged negligence, Haley has suffered from cerebral palsy as well as neurological problems, developmental delays, mental and physical anguish, physiological consequences, pain and suffering, loss of sleep and loss of pleasures and enjoyments in life.
The lawsuit also states that she has been subjected to unnecessary medical and health care evaluations, as well as incurring substantial medical expenses.
The complaint also states that St. Louis University and Memorial Hospital were negligent in their actions with the employee.
"That Memorial Hospital owed plaintiff a duty of care to use the skill and care ordinarily used by a reasonably well qualified physician," the suit states.
Haley's mother is seeking a judgment in excess of $200,000, plus costs.
