Aside from the professionals that work in them, no one likes going to court. The process is intimidating, oftentimes distressingly impersonal and being asked questions by a hostile lawyer is incredibly stressful. Sometimes, however, there are good reasons to go to court. As long as you have competent legal representation, you have nothing to fear.

Whether it's a cerebral palsy attorney or an attorney handling some other type of birth injury case, having a good one with you is very calming. If you find yourself suing for birth injuries, you're probably worrying way too much.

Most of the time, the insurance company will offer a settlement and cut a check is there if a good chance that someone involved in the birth is to blame for the injury and its aftereffects. You may end up simply giving a deposition and showing up for a hearing. You may not even get that far. If the lawyer is able to find concrete evidence of incompetence or malpractice, it's likely that the insurance company will agree to pay for it with no further effort. Most of these cases involve a lot of research and very few, if any, dramatic courtroom encounters.

Part of the hesitation that many people feel is because they're not sure that there is anyone to blame for their child's birth injury. An attorney will be able to determine if it's likely that there is someone who is ultimately responsible, whether it's a device manufacturer, distributer or the doctor themselves. You don't need an airtight case when you visit an attorney; you only need a reasonable suspicion. If it sounds like you're entitled to damages, the attorney will likely take the case and see that you get the support you need in the form of the settlement.

If you're fantasizing about court and it's making you shake in your boots, it's likely that you're imagining facing it down alone. An experienced birth injury attorney will be there with you, if you have to go at all, and the courtroom is where they're most at home. If your child suffered a birth injury that could have been avoided, you owe it to yourself and to them to seek compensation for it. Remember that many cases of birth injury-related disorders don't manifest for many years after the actual birth, but a connection may be there.
