The Process of Filing a Baby Brain Damage Claim

Filing a baby brain damage claim can be something of a complex process. First and foremost, it has to be determined by your attorney that there is a good reason to believe that medical negligence played a role in the brain damage your infant suffered. After this is been determined, the attorney will have to do a lot of work trying to figure out who exactly is to blame and figuring out how to argue the case in a way that assigns the blame squarely to that person or that institution. This, however, is all work that your attorney does. There will be work that you need to do, as well.

Cerbral Palsy LawyerThe first thing you have to do is to determine that you want to go forward and speak to an attorney about filing a claim. You can find a good birth injury attorney and hire them on a contingency agreement so that you're not putting your money at risk. The contingency agreement means that the attorney doesn't get paid unless they win. Once you decide to go ahead and do this, you'll have to go in for a free consultation with the attorney where they can determine whether or not you have a case.

It's sometimes difficult to assign a monetary figure to the pain and suffering your child has endured and that your family has endured because of the injury. You must, however, do just that in order to file a lawsuit. An attorney is a great help in doing this. The attorney will be able to sit down with you, give you a realistic idea of how much money you can expect and will make that determination based on past cases. At the very least, you should be seeking enough to make sure that any medical treatments your child needs in the future are paid for.

If your attorney advises that you should press forward with the case, you'll have to get ready to appear in court. Your attorney will prepare you for this and there's no reason to be intimidated by it. There are some cases that are so good that the party being sued simply offers to pay a compromise amount in order to get the plaintiff to drop the case. If this happens, your attorney will be there to guide you through the process and to negotiate the amount of the settlement.
